The legal landscape surrounding residential construction defects continues to evolve. Long-term and latent conditions, including water intrusion and related building envelope issues, are increasingly giving rise to personal injury, contract, warranty, and consumer fraud claims years after project completion.

This Builder Town Hall will provide a high-level legal analysis of current litigation trends and practical risk-management considerations for builders and developers. Presenter Liam Braber, Charlson, Braber, McCabe & Denmark, will outline common claim theories, emerging exposure areas, and structural approaches to risk allocation in contracts, warranties, and governing documents.*

Topics will include:
Warranty structures and other purchaser-facing protections that may mitigate future claims

Indemnification provisions and risk-transfer strategies in subcontract agreements

Potential additions or revisions to planned community governing documents to address defect-related exposure
